2) Definitions
- Usuario: persona física o jurídica que accede o usa la Plataforma.
- Proveedor: establecimiento, comercio, profesional o entidad que ofrece productos o servicios al Usuario mediante la Plataforma.
- Producto/Servicio: cualquier bien o prestación ofrecida por un Proveedor.
- Plataforma: conjunto de sitios, aplicaciones, integraciones y canales operados bajo la marca W2W.
- Bot: sistema automatizado de atención que puede interactuar con el Usuario; puede existir supervisión humana cuando sea necesario.
- User: any individual or entity accessing or using the Platform.
- Provider: venue, merchant, professional or entity offering products or services to the User through the Platform.
- Product/Service: any good or service offered by a Provider.
- Platform: websites, apps, integrations and channels operated under the W2W brand.
- Bot: an automated support system that may interact with the User; human supervision may be provided when necessary.

El acceso o uso de la Plataforma implica la aceptación íntegra e incondicional de este documento. Si no está de acuerdo, no utilice la Plataforma. La versión vigente será la publicada en esta página.
Accessing or using the Platform means you accept this document in full. If you do not agree, do not use the Platform. The current version is the one published on this page.
4) Rol de Intermediación Tecnológica
4) Technology Intermediation Role
Salvo que se indique expresamente lo contrario, W2W actúa exclusivamente como intermediario tecnológico entre Usuarios y Proveedores de cualquier sector. El contrato del producto/servicio se formaliza entre el Usuario y el Proveedor.
Unless explicitly stated otherwise, W2W acts solely as a technology intermediary between Users and Providers across multiple sectors. The product/service contract is formed between the User and the Provider.
W2W no fabrica, prepara, envasa, almacena, transporta ni ejecuta el Producto/Servicio del Proveedor.
W2W does not manufacture, prepare, package, store, transport, or perform the Provider’s Product/Service.
5) Uso de la Plataforma
5) Platform Use
W2W puede aplicar medidas de seguridad y antifraude. Podrá suspender o restringir accesos por uso indebido, fraude, impago o riesgo legal/operativo.
W2W may apply security and anti-fraud measures. Access may be suspended or restricted due to misuse, fraud, non-payment, or legal/operational risk.
- Prohibido: suplantación, spam, scraping, automatización no autorizada, ataques, o cualquier uso ilícito.
- El Usuario es responsable de la veracidad de los datos aportados (p. ej., mesa/local/contacto cuando aplique).
- El Usuario debe usar el canal y las instrucciones indicadas por el servicio para que el flujo funcione correctamente.
- Prohibited: impersonation, spam, scraping, unauthorized automation, attacks, or any unlawful use.
- The User is responsible for the accuracy of the information provided (e.g., table/venue/contact when applicable).
- The User must follow the indicated channel instructions for proper service operation.
6) Pedidos, Pagos y Ejecución
6) Orders, Payments & Fulfillment
- Antes de confirmar, se puede mostrar un resumen con conceptos aplicables (precio, impuestos, etc.) cuando proceda.
- Los pagos pueden procesarse mediante pasarelas de terceros; W2W no almacena datos completos de tarjetas.
- Disponibilidad, ejecución, cambios, cancelaciones y devoluciones dependen del Proveedor, salvo indicación expresa.
- Before confirmation, a summary may be displayed (price, taxes, etc.) when applicable.
- Payments may be processed by third-party gateways; W2W does not store full card details.
- Availability, fulfillment, changes, cancellations and refunds depend on the Provider unless explicitly stated otherwise.
Cuando el servicio incluya automatización por chat/bot, el Usuario entiende que pueden existir errores y que el Proveedor confirmará la ejecución final según sus procesos.
Where the service includes chat/bot automation, the User understands errors may occur and the Provider will confirm final fulfillment under its processes.
7) Reclamaciones e Incidencias
7) Claims & Issues
Las incidencias sobre el Producto/Servicio deben dirigirse directamente al Proveedor. W2W podrá facilitar la comunicación cuando sea posible, sin asumir obligación de resultado ni responsabilidad por la resolución.
Issues related to the Provider’s Product/Service must be addressed directly to the Provider. W2W may facilitate communication where possible, without assuming an obligation of result or liability for the outcome.
8) Propiedad Intelectual e Industrial
8) Intellectual & Industrial Property
La Plataforma, su software, diseño, marcas y contenidos son titularidad de W2W o se usan bajo licencia. Queda prohibida su reproducción o explotación no autorizada. Las marcas de terceros pertenecen a sus titulares.
The Platform, its software, design, trademarks and content are owned by W2W or used under license. Unauthorized reproduction or exploitation is prohibited. Third-party trademarks belong to their respective owners.
9) Disponibilidad y Cambios
9) Availability & Changes
La Plataforma se presta “tal cual” y “según disponibilidad”. W2W no garantiza funcionamiento ininterrumpido ni ausencia de errores. Podrá suspenderse por mantenimiento, seguridad o causas operativas.
The Platform is provided “as is” and “as available”. W2W does not guarantee uninterrupted service or error-free operation. The service may be suspended for maintenance, security or operational reasons.
10) Limitación de Responsabilidad
10) Limitation of Liability
En la máxima medida permitida por la ley, cuando W2W actúe como intermediario:
- W2W no responde por la ejecución, calidad, seguridad, legalidad, alérgenos, conformidad, precio, disponibilidad, entrega o postventa del Proveedor.
- W2W no responde por fallos de terceros (pasarelas, redes, mensajería, sistemas), ni por actos/omisiones del Proveedor.
- Se excluyen daños indirectos, consecuenciales, lucro cesante, pérdida de datos o reputación.
- Si legalmente procediera responsabilidad imputable a W2W, el límite agregado será el mayor entre 100 € o el importe efectivamente pagado a W2W por servicios propios en los 12 meses anteriores.
To the maximum extent permitted by law, when W2W acts as an intermediary:
- W2W is not liable for the Provider’s fulfillment, quality, safety, legality, allergens, conformity, pricing, availability, delivery or after-sales support.
- W2W is not liable for third-party failures (gateways, networks, messaging, systems) nor for Provider acts/omissions.
- Indirect, consequential damages, loss of profit, data loss or reputational harm are excluded.
- If W2W liability is legally applicable, the aggregate cap is the greater of €100 or the amount actually paid to W2W for W2W-owned services in the prior 12 months.
Nada de lo anterior limita responsabilidades que no puedan excluirse por norma imperativa.
Nothing herein limits liabilities that cannot be excluded under mandatory law.
11) Indemnidad

En la máxima medida permitida por la ley, el Usuario (especialmente si actúa como profesional) y/o el Proveedor mantendrán indemne a W2W frente a reclamaciones, daños, sanciones, costes y gastos (incluidos honorarios legales) derivados de su actividad, productos/servicios, incumplimientos o infracciones.
To the maximum extent permitted by law, the User (especially if acting as a business) and/or the Provider shall indemnify W2W from claims, damages, penalties, costs and expenses (including legal fees) arising from their activity, products/services, breaches or violations.

12) Force Majeure
W2W no será responsable por incumplimientos debidos a causas fuera de su control razonable (fallos de red, ciberataques, incidencias de terceros, cambios normativos, interrupciones de mensajería, etc.).
W2W shall not be liable for failures due to events beyond its reasonable control (network outages, cyberattacks, third-party incidents, regulatory changes, messaging interruptions, etc.).

- Provide the service requested and manage operations (contract / pre-contract measures).

- Security & anti-fraud (legitimate interest).
- User support: may be automated by a bot and, when necessary, include human supervision.
- Marketing: only if the User explicitly ticks the marketing opt-in checkbox (express consent).
Destinatarios y cesiones Recipients & disclosures ▶
Para prestar el servicio, puede ser necesario comunicar datos mínimos a Proveedores integrados (p. ej., establecimiento que ejecuta el servicio), así como a encargados de tratamiento (hosting, mensajería, pasarelas, etc.) bajo acuerdos adecuados.
To provide the service, it may be necessary to share minimal data with integrated Providers (e.g., the venue performing the service), and with processors (hosting, messaging, gateways, etc.) under appropriate agreements.
Conservación Retention ▶
Los datos se conservarán durante el tiempo necesario para las finalidades descritas y para cumplir obligaciones legales aplicables. Algunas solicitudes pueden estar sujetas a conservación obligatoria o limitaciones legales.
Data will be retained as needed for the stated purposes and to comply with applicable legal obligations. Some requests may be subject to mandatory retention or legal limitations.

14) Comunicaciones Comerciales

Si el Usuario acepta marketing, podrá recibir comunicaciones sobre productos/servicios de W2W y, en su caso, comunicaciones relacionadas con productos/servicios de proveedores/partners integrados o vinculados al servicio. En ningún caso se enviará marketing sin un consentimiento expreso previo.
If the User accepts marketing, they may receive communications about W2W products/services and, where applicable, communications related to products/services from providers/partners integrated with or related to the service. No marketing will be sent without prior express consent.
Para solicitar supresión de datos o ejercer derechos por chat, debe hacerse por el mismo canal usando exactamente:
BORRAR MIS DATOS o DELETE MY DATA (en mayúsculas). No se aceptan otras palabras clave en el chat.
To request data deletion or exercise rights via chat, you must use the same channel and type exactly:
BORRAR MIS DATOS or DELETE MY DATA (in uppercase). No other chat keywords are accepted.
16) Servicios de Terceros

La Plataforma puede integrar servicios de terceros (pasarelas de pago, mensajería, mapas, etc.). Cada tercero es responsable de sus propios términos y funcionamiento.
The Platform may integrate third-party services (payment gateways, messaging, maps, etc.). Each third party is responsible for its own terms and operation.
Independencia: W2W es un servicio independiente. Las referencias a aplicaciones o servicios de terceros se realizan únicamente con finalidad descriptiva de compatibilidad o acceso.
Independence: W2W is an independent service. References to third-party apps/services are made solely for descriptive purposes of compatibility or access.
17) Cesión y Subcontratación
17) Assignment & Subcontracting
W2W podrá ceder, reorganizar o subcontratar total o parcialmente la prestación del servicio cuando sea necesario, garantizando las medidas y acuerdos adecuados con encargados cuando proceda.
W2W may assign, reorganize or subcontract all or part of the service where necessary, ensuring appropriate measures and processor agreements where applicable.
18) Ley Aplicable y Jurisdicción
18) Governing Law & Jurisdiction
Legislación española. Salvo norma imperativa aplicable a consumidores, las partes se someten a los Juzgados y Tribunales de Santa Cruz de Tenerife.
Spanish law applies. Unless mandatory consumer rules apply, the parties submit to the Courts of Santa Cruz de Tenerife, Spain.
